Welcome to Caddie.fit. These Terms of Service ("Terms") govern your use of the Caddie.fit mobile application and related services (collectively, the "Service") operated by Caddie.fit ("we," "our," or "us").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Description of Service

Caddie.fit provides AI-powered golf club fitting recommendations based on:

  • Physical measurements you provide (height, wrist-to-floor, etc.)
  • Video analysis of your golf swing
  • Your stated skill level and playing preferences

Our Service also includes an AI coach feature for personalized golf advice and the ability to save and track your fitting history.

2. Account Registration

2.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update any information that changes
  • Accept responsibility for all activities under your account

2.2 Account Eligibility

You must be at least 13 years old to use this Service. If you are under 18, you must have parental or guardian consent to use the Service.

3. Subscriptions and Payments

3.1 Free and Paid Features

The Service offers both free and paid features. Free users can:

  • Create fittings and receive basic recommendations
  • View fitting history

Paid subscribers ("Coach" plans) additionally receive:

  • Access to the AI Coach feature
  • Detailed swing analysis
  • Personalized improvement recommendations

3.2 Billing

  • Subscriptions are billed on a recurring basis (monthly or annually)
  • Payment is charged at the start of each billing period
  • All fees are non-refundable except as required by law
  • You may cancel your subscription at any time through your account settings

3.3 Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers.

4. User Content

4.1 Your Content

You retain ownership of content you submit to the Service, including swing videos and measurements ("User Content"). By submitting User Content, you grant us a limited license to:

  • Process and analyze your content to provide the Service
  • Store your content as necessary for Service functionality
  • Use anonymized, aggregated data to improve our algorithms

4.2 Content Restrictions

You agree not to submit content that:

  • Violates any law or regulation
  • Infringes on intellectual property rights
  • Contains malware or harmful code
  • Is obscene, defamatory, or harassing
  • Depicts anyone other than yourself without their consent

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems to access the Service without permission
  • Share your account credentials with others
  • Resell or redistribute the Service without authorization

6. Intellectual Property

6.1 Our Property

The Service, including its design, features, content, and technology, is owned by Caddie.fit and protected by intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

6.2 Feedback

If you provide feedback or suggestions about the Service, you grant us the right to use that feedback without compensation or attribution to you.

7. Disclaimers

7.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 No Professional Advice

Important: Caddie.fit provides AI-generated recommendations for informational purposes only. Our recommendations:

  • Are not a substitute for professional club fitting by a certified fitter
  • May not account for all factors affecting your golf game
  • Should be verified before making purchasing decisions
  • Do not constitute professional golf instruction

7.3 Accuracy

While we strive for accuracy, we do not guarantee that our recommendations will be perfect for your needs. Golf club fitting involves many variables, and individual results may vary.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CADDIE.FIT SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or goodwill
  • Equipment purchases made based on our recommendations
  • Any damages exceeding the amount you paid us in the past 12 months

9. Indemnification

You agree to indemnify and hold harmless Caddie.fit, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

10.1 By You

You may terminate your account at any time through the app's Settings screen. Upon termination, your right to use the Service will immediately cease.

10.2 By Us

We may suspend or terminate your account at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Extended periods of inactivity
  • At our sole discretion with reasonable notice

10.3 Effect of Termination

Upon termination, your data will be deleted in accordance with our Privacy Policy. Sections that by their nature should survive termination will survive, including Disclaimers, Limitation of Liability, and Indemnification.

11. Dispute Resolution

11.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at support@caddie.fit to attempt informal resolution.

11.2 Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

11.3 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property matters.

12. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms in the app and updating the "Effective Date" above. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

13. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Caddie.fit regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
  • Waiver: Our failure to enforce any right does not constitute a waiver of that right.
  • Assignment: You may not assign your rights under these Terms. We may assign our rights to any successor.
